He has the right to crack his window and after the cop asked him if he was trying to be cute he could have easily diffused the situation and rolled the window down the rest of the way and let the cop know he wasn't trying to be a smart ass, the comments about rolling his window down are about not respecting the police officers and hiding the tint. Sometimes showing respect will help I was with a 22 year old that got pulled over doing 100 in a 65 and managed to get away with a verbal warning by being respectful and getting extremely lucky for getting a cool state trooper I have no doubt that if he acted like a 5 year old he would have been arrested

Go back and read ALL of the comments. Yes, a few people were telling him he should have rolled them down so they wouldn't see the tint, but there were also a bunch saying that "he was just being a smart ass" and "you should have just rolled it down when he asked."

Yes I know being respectful will go far. You catch more flies with honey than you do with vinegar, as they say. None the less, IT IS HIS RIGHT to only crack the window enough to communicate with the officers. Telling him that he should have rolled them down all the way instead, is telling him he should give up his rights and is UNAMERICAN.

HOLY CRAP, you had illegal tint pay the fine and suck it up. I am sick of people telling others "how to get away" with illegal things. Its like a drunk driver getting mad at a Police Officer for catching them or a shoplifter getting mad for getting caught. Its your car if you want to keep 15% tint on it more power to you but dont get butt hurt when a Police Officer does his job enforcing the law by writing you a citation. Pay the fine and move on. Additionally do not listen to some of these backyard lawyers telling you this and that about the law and what your rights are and what not. Do research, google is an amazing thing, and know your rights. Most people who say something is illegal or you have the this right heard it from someone else or only read part of the law.

Not a hypocrite. Rolling down a window to keep an officer safe is a REASONABLE request. Submitting to a search with no probable cause would be being a hypocrite. GFY.

You broke the law! Your tint is too dark. I have a strong disdain for Police, but I, as others have said, always am polite and courteous when pulled over. It's yes sir and no sir. My goal is to not get a ticket......thats all! How were they taking advantage of you? learn what battles to fight, drop the chip you have on your shoulder, and enjoy life. You can hate the police....I get that...but never let them know it!

Fight the ticket, it will only cost ya some time out of your day. Tell your story, seriously; the cop said he smelled weed as you drove by with your windows shut, come on. Then let the judge/advocate know you where offended by the treatment and disrespect they showed by profiling you as a common criminal. Make the tint a secondary issue, citizens should not be Profiled and harassed. Ask the judge if you should make a complaint against the officer. The officer told you if you had rolled the window down completely - no ticket would be issued. Really...... Let the judge know you understand the officer must of been having a bad day, but that's no reason to take it out on you!

Quick story: 1am I pull off the hiway and tearing down the off ramp Bang, my radar detector starts clicking, so I slow down to the speed limit. As I go around the rotary at the bottom of the off ramp, there he is sitting in the parking lot looking for speeders. I drive past heading home and of course he pulls out and follows me. Tailgating, you bet, my radar detector is Screaming full blast and the cop is three feet off my ass, for a mile plus, so I know he's already running my plate. I keep it right at 50, the posted speed limit, and sure enough the Blue Lights come on.

First question; you know why I pulled you over, and I say "well I know I wasn't speeding" and he snaps back "well you sure came around that Rotary fast" and I said "Really?" Then he tells me I was driving on "the fog lane/line". And I'm like What the Heck is that, I never heard of that, (the white line along the shoulder). If anything I was much closer to the center line I said, which immediately snapped me into reality when the officer responded with "Are you calling me a Liar."

Call it an immediate Epiphany moment, I knew I was Screwed, and nothing I said mattered. After fifteen minutes sitting waiting he comes out of his car and he hands me a warning ticket. At the same time an on coming state trooper with lights on stops to see what the deal is, they have a few words and both take off in the same direction.

A Muscle Car, 1am, cop took his chance that it coulda been an arrest, alcohol/drugs, all possibilities in this scenario. But none of those circumstances where there, just got off work and was heading home. But the bottom line is the officer pretty much has free rein. Who's gana call the cop a liar???

It is very simple...Motor Vehicle stops can go two ways.
1) Be polite and respectful and there is a good chance you will slide.
2) Be a dick, record a cop, and tell them you know your rights. 100% guarantee to get a ticket.

Now fight a ticket in both instances-I would bet big money that even the liberal judge is not going to be sympathetic you saying that it was given out of spite. But please feel free to continue to do it your way, I am sure the cop on overtime at the court appeal appreciates you paying for their car!

With respect to rolling down the window, the cop may have said if was so his partner could hear, but as others have said, it's also in part so the officers can see who and what is in the car for their own safety. They want to see what the occupants are doing with their hands. are they both in plain site, is someone reaching for something? They will feel a whole lot safer if they can see inside the car.

Unless you don't have any rear side windows, rolling down the windows won't prevent the officers from seeing that your windows are tinted unless you roll ALL of them down.
