Germany did do this when I lived there and it is not based on the price of the car (which some seem to be confused about) rather the INCOME of the driver. It then hurts equally across all income levels

If you really want an eyeopener, check some of the DUI laws/penalties in Europe.

will it really stick though. Seems like he could also afford a top notch attorney. That may be the fine was assesed but what amount did he pay after appeal

If it’s anything like Germany 85mph through a village deserves to lose their license! I’ve driven there twice in the past 3 years and the roads (2 lanes no shoulder and a good sized ditch) were 80 km/h just outside town and when you hit a village it drops to about 35 km/h. With all the curves in the road it was fun going through the gears even though it was pretty damn slow. They also have speed cameras everywhere but they warn you when one is coming up. My boss sped over there thinking f' it I don’t even have a license here... They mailed my work the ticket in the US!!! It had a picture of him driving and a picture of the back of the van with the plate. They traced it all the way through the rental company!! Germans, so meticulous! Also, the majority of Germany was farming areas like Iowa or Nebraska. Obviously the bigger towns were good size but once you leave town it was extremely rural.

Cool side thought.. People can legally drive ATVs on the roads in Germany!!!
During the morning/evening commute I saw 3 or 4 every day riding to / from work with backpacks carrying all their work things.

I actually agree with the idea of scaling traffice fines relative to wealth and/or income but 1% of your net wealth for 85 in a 50 is just the court robbing the guy.

Keep in mind the article says that he is a repeat offender. Most places that means the fine/punishment gets larger each time.

This is completely WRONG.

Driving is a privalege NOT a right.

So... the "income based fine" is just another way for the nanny state to take something that doesn't belong to them.

The CORRECT course of action is to fine the person the normal fine that everyone else pays and because he's a repeat offender then you take away his license. That is the ONLY legitimate and justified punishment.

The idea is not to take advantage of someone's wealth to stick them with some arbitrary fine so that the municipality can get a windfall and spend it like a politician!

A strong argument can be made along those lines when talking about taxes but if you are going to have monetary penalties for breaking laws it makes perfect sense to scale them relative to the individuals wealth. When they don't scale you have to choose between fines that are so small that they aren't a meaningful penalty to those with wealth or fines so large that even minor infractions will be unaffordable by those with less. It's exactly the same reason that the person's wealth is an important part of setting bail amounts.

cabg2, you wouldn't being saying that if you were a millionaire...it just like taxes in the U.S. Sure, I make a little more than you're average person, but do I use the services (i.e. roads, police, fire, etc.,) more than anyone else? Of course not...but I still have to pay higher taxes...everyone should pay the same price to live in this country...and if you can't, then oh, well...you'll have to go somewhere else (plenty of other countries out there in the world).
If the speeder was driving a piece of crap (since he couldn't afford a Ferrari) 35MPH over the speed limit, then he is just as dangerous as the millionaire and both should pay the same fee. That's equality!

Just like on the reality show Survivor...so many people believe that the person who NEEDs the million dollars should get it...sorry, it's the person who outwit, outplayed, etc., the other Survivors, regardless if that person is a pauper or a millionaire, should receive the money.
