Highway patrol stalking me?? Help!
So how bout a Hi-Po came knocking on my door today, asking for my drivers license, and asking if the vehicle in my garage was mine and I am the one who was driving it on Sept. 15th at about one oclock. (My garage was closed but he looked in the little windows at the top.) HE SAYS, he was on the side of the road, and I came speeding by at 80mph, but there were some cars behind me so he had to wait to pull out, but that I sped up and got off the next exit which was about 1/2 mile from where he was parked. He said I had to be doing 100 mph on the ramp. Then I lost him in my housing edition and parked in my garage. HE SAYS. I am absolutely clueless about all of this. He said he put out an 'APB' (or whatever) and local cop saw my car from the description ran my plates and he was able to track me to my house. He didnt give me a ticket but was a real JERK. Could he have given me a ticket? Is it legal to for him to go poking around my property???? Can I file a complaint? In all honesty I told him that that was probably me doing 80mph, that sounds about right, but the whole high speed chase didnt happen. He just kept trying to get me to admit to fleeing and I told him to write me a ticket for speeding or let me go back inside and enjoy my afternoon. He just told me to never do it again and I said 'you got it'.... ??????? If he could have given me a ticket why wouldnt he? He was a JERK!!!

Don't confess anything. Tell the officer to prove it or go away. Cite your 5th Amendment rights.

imo he cant do anything without evidence of the actully situation. i would have said to the cop read the lisence plate number of the car he apperently chases. if anything is wrong about the plate or he didnt get it than he has no evidence to give u a ticket. but by the sounds of it the cop was being a prick.

citations can only be given if he has proof (video, camera, tape recorder, or stopped while in the commission of the crime). If you where indeed in a "car chase" with him his on board camera would have your license and therefore it would not have been a nice knock on your door, it would have been an arrest. Basically this guy is either doing 1 of 2 things. Harassing you because he can as a cop, OR he is giving you a warning of a lifetime (because he has evidence and is giving you a second chance).
Keep your nose clean and drive safely and legally. Personally I would also go take pictures of your property RIGHT NOW with a time/date stamp to show that your garage is closed and i would write down everything exactly as you remember it. So that if he does show up in court you can provide proof that the circumstances where shady at best.

call his supervisor & file a complaint,
then if you ahve a video camera, place it in your car to record everything, if he follows you(harrasment) you'll have it on tape, be extra careful for the next couple of weeks. ps: where were you on that night? |

Only Congress has the constitutional authority to punish pirates. That's out of Officer Crusade-Against-Speeders' jurisdiction. Obviously, the 5-0 has no idea that the Constitution also protects srtclg1007's rights regarding search, seizure, warrant, and self-incrimination.
Everyone in America should take a course in Constitutional law. Actually, everyone in a country with a constitution—any democracy except the UK—should take a constitutional law course of some sort. If you don't live in a democratic country, move or start a revolution.

There is nothing illegal about looking in your garage. No supervisor would ever take a complaint for that.
Tracking you down? Simple and legal. Sometimes stories differ...and I'll say that my grandpa has seen lights waaaaay back behind him before and turned off the interstate to see if they follow...mm hmm... Regardless, there are two sides to the story. Not to be a jerk and side w/ anyone here...because I'm not doing that...I'd have to hear both. Sounds like he was trying to stop you (which you admitted you might have speeding) and he tried to get to you, but could not safely do so. Now, what I'm curious is how he got your plate....if he got it that night or if it were the other officer who happened to see it and say, "hey! this coullllld be it." If you would have said "yes. That was me. I saw you. I took off. I'm sorry." You'd be expecting a warrant to come out. No...he couldn't have given you a ticket right then and there....but I'd be more worried about felony evading in a vehicle over a minor speeding ticket. |

I agree with diarmadhi, If you was on his dash cam and that locks in the laser tracking for the speed, and he knew where you lived, so he had your plate #.
He did have the right after the speeding laws was broken, and feel lucky because some states allow the police to tack on reckless driving, school zones,construction and a whole lot more. The officer did give you a break, but if you feel he was just after you, see an lawyer and get his advice. The life you save may be yours, Drive, but drive safe.

There is a legal term called "hot pursuit". This basically means that even if you evade an officer for the moment and they find you with in a reasonable time frame and can articulate that the investigation was ongoing that he could make an arrest. In most states it is now a felony to flee in your vehicle. I am not saying that you were fleeing and that maybe you were just driving quick and the officer could not catch up to you in time. It of course would be the responsability of the officer to prove that it was you driving. You did do the right thing for you by not admiting to knowing that the officer was trying to stop you. Yes some cops are dicks but I know nothing makes me more angry then when someone runs, so I would have gone to great lengths in tracking you down as well. And just FYI, in all academies across the country there is a very long block of legal instruction in the area of constitutional, traffic and criminal law. No one on the street is ignorant about those rights. All in all it sounds like the situation worked out fine for you. If you were speeding and got away and all you ended up getting was questions then just be thankful. If you decide to file a complaint then you are just bringing heat on a done situation and then you might be seing alot more popo in your hood. Just my $20

You admit to speeding, you only got a warning so you have no argument of innocence and you have no damages. You haven't mentioned any behavior that constitutes harassment. The officer went precisely to your house because you had a vehicle matching the description. Then he looked in a window presumably in front of your house which qualifies as 'in plain sight'. Just slow it down. If you find the officer parked in front of your house for a week, then you can talk about harassment. |
