If you've already been to traffic school you're not getting it dismissed and chances are the judge won't show any leniency as you've shown you have a habit of excessive speeding.
Also check the state law because most states say that if you take the traffic school and you get another ticket within a certain time frame, you have to pay the fee for the first ticket and it also goes on your record. You may end up having to pay for both tickets and both of them being reported to your insurance. Because of this, I would contact a lawyer and ask questions and find out because this ticket may be the least of your worries. As for flying by the cop while he is sitting still, it's easy to estimate someone's speed doing this. Not to mention he also has his speed that he had to travel to catch up and the time it took him to do so to further calculate your speed. |

I'd fight it
The worst is you lose. We have a deal here you pay the FINE and it goes into a dead zone for a year! You get no same or similer tickets in that year and its GONE, never to be seen by your INS. it's expunged from your record

First of course is if you were speeding then oh well and own up to it. Now that the lecture is out of the way.
My take is this, I try like the dickens to make sure I'm aware of the speed limit and don't speed. But should I get a ticket ever again I will hire an attorney. My experience with traffic violations is that a decent attorney can get them reduced or eliminated enough such that his fee is offset by insurance not going up. So higher a lawyer, let him do his thing.

Take a online driving class, go to court and challenge the ticket. Most officers who are radar certified also were tested on their ability to give speed of moving vehicle by sight. This officer appears to need remedial training in his traffic stop tactics, many of the experienced officers will teach to either give someone a ticket or an ass chewing but never give both on the same stop.

As mentioned above and I've also been told by a magistrate that police officers were trained in estimating speed sufficient to give a ticket and that it was recognized in court. That was many years ago, however, so maybe that doesn't hold.
My guess is the officer will simply state he was giving you a break at 50. By the way, if the judge or magistrate asks you, "well how fast were you going then, sir". I don't know is bad response. Lying is also a bad response. And for fun, I recall years ago on a trip back from skiing in Colorado my friend got pulled over in the middle of the night. I was sleeping in the back of the van and the wig wags woke me up. The officer approached our van and my friend says, "why did you pull me over, I was only going 70?" His response? "Sir, here is your ticket for going 70 in a 65". I still laugh at that.........he doesn't, but I always do.

I just got one for: Unsafe start from parked/stop/stand- what a load of crap, did a uturn and accelerated "spiritedly" to the speed limit. Never saw him until 2 miles down the road when he pulled me over. could not get me for speeding as I was doing the speed limit, that's all he had.

Well, I called a lawyer and the fee will be $450. That would include having my court summons moved elsewhere as apparently the local courthouse is full of hard-asses. She seems to think the best opportunity for mitigating any consequences would be for her to negotiate with the officer at the courthouse. I think I may have to go for it.

I beat a ticket just as you described, No lawyer, just described to the judge that not only is my car very loud (2" KOOKS, Hi-flow etc) it is IOM am standing still my car looks like its speeding...Judge agreed...without radar proof, pose the reasonable doubt scenario...this is AMERICA! Use you rights..IF THE GLOVE DON'T FIT, YOU GOTTA AQUIT!

To avoid points and rising insurance premiums, hire a lawyer. Google "traffic lawyers SFO" or where ever you got the ticket. There will be dozens of firms that do this for a living and they're not expensive. For 15mph over maybe $100-200 and you never spend time in court or more than 5 minutes filling out a form explaining the circumstances. They'll contest it for you and you'll almost certainly walk away without points.

Why get a lawyer?
In Ohio, and I just did this, you can go to court. Ask them to make it a non moving violation without points. |

If it's a different municipality than the last time you went to traffic school then they may not have record.
Here is Bama they completely keep it off of your record and the particular court you're in keeps the record. If they ask you just say you don't recall. It's not perjury if you 'Dont' Recall' hahahaha I've been to traffic school in 3 different courts. None knew of the previous so I was able to go to traffic school. This is back when I drove a truck. Worth a shot. I also agree that you don't need a lawyer. State your case and be accepting and not accusatory and you may get lucky. |

In Cali, the most you can hope for is a reduction. They will fine you even if you can prove the officer was eating donuts and watching youtube on his cell phone when he pulled you over.
