Passenger wouldn't have survived, if you look the area around him (the driver) is pretty clear of debris. The passenger seat has shit all over it.

Distracted or DUI. I don't see how you run into the back of a tractor trailer that hard if you're not in the wrong somehow.

I don't think he is so lucky - I can see like everyone else a DUI or distracted driver - in either case in a car like that he should not be allowed on the road again ever in anything more than a smart car

My girlfriends Dad is the safety officer at a Trucking/Freight Company with 270 trucks. 3 people a year die by rear ending them. Every year.

Semi is going 20mph up or down a hill on the highway, no brake lights on, and someone who is not paying attention runs up their ass at 70. They don't see the speed difference until it is too late.

I put my 73 Charger SE passenger side under a Flat Bed truck. Worst accident I've been in. I wasn't speeding. It was on a 35 mph street (Sunset Blvd), going around a curve with a hill on the inside right. He was parked in the lane, no warning cones or anything. I had nowhere to go, and ended up going into the other lane (and hitting a VW bug) as I got halfway into its lane.
