the GF bought a dodge from a honda dealership while i was at work....

So Im not pissed that they sold her her a dodge caliber for 2k higher than it's bb value nor that they low balled her mustang trade in for 1.1k less than it's bb value. she tells me they called her today and said that they are changing her monthly payments to something higher than what she agreed on and signed the contract for.

now before I go headbutt the sales manager and talk to my lawyer do you guys have any advice?

Take it back, they're violating an implied and express contract.

The bad deal is on her however.

check your state laws.


dealership can't do that in most states far as I know.

they can request the vehicle back if they can't get her financed. but they need to also return her vehicle and any down payment.

With the signature on the contract that makes a contract called an express contract. That's enforceable by law, if the dealership doesn't like it then fine.... let them take the car back and get a better deal elsewhere..

Thats what I thought was the case, just need to look up arkansas laws regarding this.

That's just contracts in general though, she made the express contract, so she's covered, you should be fine.

Honestly, they probably think that hey she's a girl, we pushed her around on the pricing, we can push her around here. No offense to your girl, but that's probably what they thought.

She probably signed something saying if they couldn't get her approved at the rate quoted, her payments may change if approved at a higher rate.

This is most likely what happened. Can't believe people this day and age still shop for payments instead of bottom line price. The dealer probably won't have a problem telling you why the payment went up but can't imagine giving the car back being an easy process. Good luck.

In fact, if this is what happened, you are pretty much stuck. Unless the contract included a cooling off period, the dealership is not required to take the vehicle back in the state of Arkansas.
