Doesnt matter lol. I think by passing out in the driver seat, it could show you had the intent to drive under the influence, but passed out before it could happen, which makes sense to me

Yes but it court you would have to prove intent beyond a reasonable doubt. Say a hypothetical person was sleeping in the drivers seat at the bar, the prosecution would have an almost impossible time proving that intent. Now say if the car was parked several blocks down from the bar in a neighborhood....
