In ohio if you pass out in the front seat while being over the legal limit, your car could be parked and not even running and you can get a OVI. Bc by getting in the drivers seat that is like saying you intended on driving your car under the influence

Its almost impossible to prove intent if the ignition isn't turned.

I think around here as long as the keys are in the ignition and your drinking in the vehicle with it not running that it is a dui, always keep keys in pocket
