I was hoping someone in law enforcement would chime in, I didn't know what I would be trying to get. A harassment order seems to make more sense

Well, an officer just left my house, filed a complaint and got it on paper. He said he was going to talk to her douchebag boyfriend and tell him to knock the shit off. I'm kinda relieved at the moment lol

you should have called the police immediately when the truck was doing all this. i just went throught the restraining order process last month to a ex bipolar. i was ignoring him and it made it WORSE. he threatened me and my friends not to mention police filled my voicemail and texts up with incriminating evidence on himself. you need proof of threats and seriously believe you are in harm.you mentioned threats but didn't go into detail, a judge has to look over your complaints before he/she will approve a order of protection(in arkansas anyway not sure about there)then you will have to go to court and see this person(unless they don't show then it's automatically enforced)to approve the order. it's a lot of trouble and loss of work/school blah blah... again,if you feel seriously threatened do it,if not just make sure you document anything and everything anyway.i filed a police report on the texts so there is a paper trail,i'd report the truck incident. just my 2 cents

Bravo for taking care of it Bulldogwinters! In my experience, people never follow up with it until it's too late and something ugly happens. Good move.

FYI, carrying a bat is illegal in some states (some carry a glove and baseball in the trunk as well.) I know we have some LEO on the forums. I'd get a concealed carry permit or something that's easier to stash. I'm a small guy, and I've had to grab for stuff before man. It really sucks getting put into a corner or threatened.

Find the dude when he's not expecting it and by himself and jump his ass, although since you started a paper trail that might backfire. I got jumped second day of my freshman year in high school by 5 dudes who were jealous of my dads car that I drove. Found 3 of them by themselves and taught them a lesson, they didn't mess with me again. Don't fight fair either, 5 on 1 wasn't fair so me using a bat wasn't fair either. If it seems like it's going to escalate to something bad, make sure you end it before you get caught off guard. Since you seem to be handling it well for now and started a paper trail don't do anything unless you need to.

Let me preface this by saying I don't know your states laws. I'm going to tell you what would happen in Texas and from an officers stand point.

First things first.

You need to start a paper trail.

Call the police and get a report. You don't have enough for harassment, but you can get an info report. 17 calls in one day here in San Antonio won't get you charges against the other person.

The purpose of this is, again, to start a paper trail. Then, the officer needs to either go by her house or business as well as the guys. Both need to be told BY THE OFFICER to stop what they are doing (all forms of communication and that they need to stop with the stupidity on the roads - which is coming next). By giving them the warning, which is what is needed to further pursue charges, you have set a precedent and they now know what to expect should they continue.

This should stop the calls and what not.

Next, you say that you saw the red truck with stickers and all. But, can you factually say that this was them? Can you say that you saw her and that you saw her new boyfriend? If so, then that can be included in the report. If you didn't actually see them, then you have no proof....coulda been some jack ass messing with you.

No charges at this point.

A restraining order is something that a court would do, but is not enforceable by law enforcement. That's more of a civil thing and a Judge could do something to the violator later on, but we can't do anything about it then and there.

Again, this is by TX law. So, things might not line up the same. Remember, step 1 is to put it on paper. You do have the right to defend yourself should it come to that. But, as with any type of situation, we tell people to do everything they can to prevent that situation from coming up in the first place.

See what happens when I read post 1 and then skip to the end? hahaha....

but, you MUST do this.... Ask the officer what happened when he talked to him. FOLLOW UP. Sometimes officers say they will talk to someone and if they couldn't get a hold of them, it gets put on the back burner and won't get done. Follow through! Call the officer back and ask what the outcome of the situation was. You NEED to know.

When you get older your brain changes in these type of situations, young folks look at it that part of this might be your fault so you don't call the police right away, good to ask advice. When you get older you realize that your not going to put up with the crap and call the police right away get license plate number and file right then and there. MY .o2

Pretty much hit the nail on the head...I've been a LEO for over ten years now at local level and federal in several states. As for the other side of it a juvenile deliquent myself in my early years...yes we go one way or the other...jail or law enforcement...getting in a fight will not resolve it...and from a perspective of crazy chicks in college...just flat out ignore her and make sure if there is another you do a clean cut to the relationship...nothing worse than someone who cannot get over it that goes for girls with crazy boyfriends as well. Thats the daddy in me...mine oldest will be dating in the not to distant future, and I hate sounding like a parent, but she will know how to handle herself. I feel sorry for the guy that steps over the line with her.
