Car being taken back by dealer??? What??
So, last weekend, I helped my sister find a new car and make a deal. I found her a low-mileage Ford Explorer that she absolutely loved.
It's a 2010 Ford Explorer Eddie Bauer 4x4, 2100 miles. Was a previous Ford 'program' car (no, not a rental). Negotiated a great deal, $27,5. Basically a brand new car and a smoking deal. One week passed by today. She just got a call from the Ford Dealer, and they told her they have to take the car back. No, nothing is wrong with the financing. The car, for whatever reason, cannot be sold or licensed in the state of Washington. They stated it had something to do with the emissions. Sure enough, in the engine bay is a sticker that says the vehicle is not legal for sale in states that require cars to meet 'California Emissions Standards' (apparently Washington is a state that also requires CA standards). It's written in our state laws that used cars newer than 2009, less than 7500 miles, that do not meet CA standards cannot be titled in this state. Does this even sound legit? The dealership said that all 5 of these Explorers (they bought 5 exactly alike, from the same supplier, all with less than 5k miles) had to be taken back. I'm pretty much speechless. Has anyone encountered anything like this before? Recommendations on what to do? |

If the vehicle CAN pass the state emmissions test shouldn't it not matter if it was originally designated to do so or not? Either way that dealership better be forking over some cash to avoid a lawsuit if they did violate some law and sold that Explorer...

If the dealer bought the vehicles at an auction, they could have recieved incorrect information that they would not have been aware of untill they recieved the titles. Talk to the dealer before you get too upset and see what they are willing to do for you. Lawyering up early can cause the dealer to dig in and give you nothing. Besides, if they offer you anything, they are admitting partial responsibility and are setting themselves up for a lawsuit.

Also consider the upside, they didn't leave you hanging in the wind and you find out months later and your stuck on the hook with a car you can't drive but must sitll pay for.
That is unless you have already plated it, but id guess she still has the 30 day tag n while getting her the paper to get a real plate, they found the mistake??? |

Thats easy...move to a better state..........like Iowa for instance. As long as you have cats you're legal (even if they're gutted)

Kentucky got rid of the VET testing years ago. Theres not any type of inspection here, like in northern states.

Drive to the florida keys and back. that should put you at around 7500 miles.

I don't think she'll have a choice, the state won't issue a title. That dealer should work out some great deal on another vehicle to make up for it.
See if they can get her a nice Chevy .
