I agree seems the ferrari is at fault here. That will teach him to drive a car that's nose doubles as a ramp.

well in MOST states.....all that I know of anyway.....ALL vehicles are REQUIRED to yeild the right of way to all vehicles which are ON THE ROAD....the truck clearly wasn't....regardless of what the Ferrari driver may or may not have been doing...the driver of the truck was in the wrong. HE was entering onto a road way into uncomming triffic.

I see alot of that crossing over the *double yellow line* from folks in a hurry.

But you are taking a chance when allowing drivers,that are coming out of car washes,gas stations to go thru.Most of time they don't utilize their turn signals (ya know cause that's optional ) and you have no idea which way they are going.Sometimes tying up traffic to get to the other side or causing an accident like the above.

If you read the actual report and eye witness testimonies, yes he was stopped in traffic at a light but he got impatient and tried to pass everybody on a double yellow line and that's when the truck hit him. He was not sitting still as he claims to be, he was driving in oncoming traffic. This accident is totally his fault and he knows it. He's trying to spin it around and say it's the trucks fault because he doesn't want to spend $25k on the repairs.

maybe it's his fault...


like was mentioned above, in many states... regardless of location or orientation or violation; oncoming cars must yeild to the right of way of all on road traffic.

(not to mention, the truck was trying to turn left, out into and across the double yellow himself; he should have turned right and then made a U turn technically)


my guess is that the fault will get split. and that guy driving the truck will be more careful about merging onto the road.

I've written a couple of accident reports similar to this where someone was doing a quick illegal (and usually harmless) manuever where it ends up costing them big. The Ferrari driver is 100% at fault. I would have also (obviously) cited the Ferrari driver for crossing a double yellow line/divide, and/or for driving against on-coming traffic. The Ford would have only been at fault if he would have hit someone who was legally driving on the other lane since he legally entered the roadway.

Maybe you are right, in some states a vehicle driving illegally may have right of way over another vehicle. I just don't know what states those may be. I'm interested to hear which states those are. In California, someone following the law has the right away over those that are not (except for maybe pedestrians, but those are still a flip of the coin sometimes).

That is a lie. You are ALLOWED to cross the double yellow line. IT IS COMPLETELY LEGAL. I WOULD KNOW.

When coming off of an off street parking or driveway, you are allowed to cross the double yellow line. The only time you are not allowed to would be if the center has double yellow lines that are 2 ft. apart or more (a painted island).

It also would have been illegal if the truck crossed the double yellow line to make a U-turn.

the ferrari driver is at fault for passing in a solid double yellow road, the truck not yielding to oncoming traffic, but maybe the truck driver did not notice the ferrari on the wrong side of the road he was turning onto(hence the picture)...

I'm with Evil on this one. I would love to know what states you're talking about. All the ones I've dealt with, if you cause a accident while performing an illegal maneuver, you're automatically at fault regardless of what happened.
