Complain to the landlord that you are being harassed. Ask them to either let you out of the lease, reduce the rent amount, or shorten it's duration giving both of you to find a home and a new tenant. Also as a person who has friends that rented to people you should know that you have all the power (legally). You could say you're going to move and not pay and you'll take him to court if an acceptable agreement can't be made. Get in front of Judge Judy and your golden. lol

Call Alameda County Sheriff and express your concerns. Are you in Via Via land or where at in San Lorenzo? I used to work the area and can tell you if the area is safe or not.

If you're anywhere near the Avenues (150th south to 238), run don't walk!!

Being a landlord I feel that you should talk to your landlord and try to work something out after you explain your sititution. Having good tenant's in this economy is very important to a landlord. Turnover is not good, it cost us landlord's money everytime someone moves out.

I'd say move as soon as possible. If this person's girlfriend is coming by looking for "stuff" (what that is alone would make me want to move), who knows who else might come by. Look into breaking the lease (and possibly look into whether or not the land lord knew the situation but didn't disclose it before the lease.

Until you're able to get out: 2nd Amendment.

I know about the 2nd ammendmant, but if someone trespasses in your house and you shoot them but don't kill'em. Can't they sue the crap out of you?

In Texas?! HEH. Nope. Just remember it's only his word against yours if he can speak. In all seriousness, I believe you'd be covered under CASTLE doctrine. If he/she breaks in, you have the legal right to defend yourself, your home, your fiance, your property, etc. The onus would be on him to prove that he wasn't committing a felony B&E with an attempt to take your life/property/etc. Any LEOs can elaborate, but you can always check with the NRA, they post laws from every state on their website: NRA.org.

Well in that case, I'd say stay home if the OP was in Texas. I've had a friend shoot a tresspasser in the leg w/ a bolt action rifle and fled out of his house tracing blood everywhere's. Wasn't the prettiest, but anyways.. OP, just make sure y'all are safe. Moving out, w/e you feel is best.

Not here in CA... You can only shoot if your life is in danger. So my theory is is, shoot until you are sure they cannot make it to the witness stand, otherwise, you're getting sued! F'ing CA laws!

Back to the topic, I work in the rental field here in San Jose... Legally, I dont think you have much to go on. It really depends on the landlord, and how they want to handle the situation. I have old tenants show up all the time to check their mail (I tell them they should have forwarded it, sorry)

Start filing police reports for any shenanigans going on. This can be used as evidence/barganing power to break your lease (without penalty). Keep a log of all the events, even minor ones.

Make sure they changed the locks!!! If you are not sure if they did, ask to hire a locksmith and have them pay you back ($85 plus keys). Make sure the place is well lit at night. I added on a bunch of lights at my house (rental) because I wanted to be able to see everything at night.

Every Landlord me and Bonnie have ever had before we bought our house offered us less rent to stay. lol

Quiet, well mannered, respected tenants that PAY THEIR RENT ON TIME, are not easy to find as a landlord.

Ask your landlord if he has any other available rentals. Let him know what is going on.

I can't believe the officers wouldn't give you more info.

Thanks everyone for the advice. I have left 4 messages to the landlord with no call back.. Everything is a little better it is just not the most comfortable experience. I would like to move its just so hard to find a place in this price range with a garage and a backyard. (also having to move in the middle of the school year)
We are going to see what happens. I was able to contact the police station, they said they have not apprehended him and that he has felony warrants, but they wouldn't tell me for what.
