Man i feel for you!

1. Get a lawyer
2. Check to make sure the Cop is current in his cetification* if not he is not a cop at all, and the ticket will be thrown out.
3. If you get a lawyer and go to court, telling the judge you made a bad judgement call, and basically confess to your sin, be sincere and look him in the eye and tell him it will never happen again.

4. It won't be a walk in the park. but....you didn't kill anyone, you werent selling drugs, you didn't reckless display a firearm. rob somebody, beat somebody.

i mean you have a generic violation. and it was under 100....something about triple digits really anger judges. My best friend is a captain in the HWY patrol.

personally i used the certification tactic about 8 years ago. the trooper wasn't up to date on his certification...he was just a citizen in a uniform. 85 in a 60 got thrown out. Nothing nada.( i was gong to the hospital to give my father blood !) and i was an ER tech at the time in uniform.

The only thing you can take away is......you definity will think thrice, yes thrice! about doing that again

was it radar? or did he actually clock you. either or....was the radar gun calibrated that day? was the cars speedometer accurate?
as i said in another thread, if OJ can get away with MURDER. Throw enough money at it and you can find a way.

Just saying, i don't think BIG WILLY should be pounding your rear for a speeding ticket. So if thats what you think your facing.
fight it, turn over every stone. be smart. Asking for a jury trial may also get the DA to make you an offer. considering your record.
we have probably scared you more than what will actually happen.

You have many tools right now. with respect to the cops here, you aren't in the position to judge, just state facts.
( how many cops get off with a warning? when they are pulled over? funny they take there liscense picture in uniform.
if i was an attorney i would say those that do that ....know they will get pulled over) i beleive thats called intent!

You should pay a fine. and MAYBE school. The waitiing is torture enough.

I'm not saying you're wrong or that it didn't work for you... but this is false here. Even if the Officer isn't certified he can certainly justify someone driving at an excessive speed. He could confirm it with a RADAR or LIDAR and still not be certified. Come court time though, he would just have to have the charge changed to Careless/Reckless Driving or other such similar charge. In most places you wont just get off if the certification isn't there. The civilian in a uniform comment is uncalled for as well. He's probably had plenty of training to know when someone is driving like a jack hole more so than your average citizen.

Sorry to hear this.

I HOPE YOU LEARN FROM THIS.

What if a dog or deer ran across the road when YOU were driving

like a FOOL on public streets? What if a child was running after a ball?

I really HOPE YOU have learned from the LUCK you have had. IF there is

a next time, I hope and pray to GOD an innocent person isn't in the road.

I'd say be prepared to pay a very hefty fine and possible have your license suspended as that speed can be intrepid into reckless driving..

If you are lucky the judge will take your cooperation at the time of the stop, your willingness to accept punishment for your actions, and will just lay down a fine that will curl your toes..

I'd also expect your insurance company to either cancel your policy or triple your premium...

Agree!!! I recently took an early retirement from a major police department.. The tactics he mentions may have been useful in the 70's or 80's... The prosecutor WILL have already covered that the officer is properly certified and the officer and the prosecutor will have a copy off that certification on hand...

The officer visually estimated the vehicle speed BEFORE even activating the radar.. To be certified an officer must be able to be within +/- 3 mph of actual radar speed..

We had many reserve officers who are radar certified. Getting a ticket from them was NO different than getting one from a paid officer...

These days, radar certification is mandatory and given in the police academy... Every officer in my department was radar certified even if they never want to run radar...

The information given my Napper is BAD info...

You were doing 50 over. You are not going to get off easy. Prepare to fork over some cash and maybe go to some sort of traffic school.

I understand my consequences I was in the wrong and I know there are what if's....but FACT is all I was doing was speeding... no cars around(except the cop go figure) early morning like 7am on sunday.... no one got hurt, I didnt have accident cause I was paying CLOSE attention in front of me so that I could avoid whatever. Im gonna do what I can just to keep from dishing out alot of money, but I learned my lesson...exactly when he told me "1 more mph and you would have been arrested and your car would have been impounded!" thats scary and I DONT wanna go throught that...let alone what Im about to. I'm lucky its just that! Thanks everyone

One...I don't believe I ever said he would share a room with BIG WILLY for a speeding violation. I believe I clearly specified his manner of driving resulting in the death of a human being.

He is not entitled to a jury trial...it is not a criminal offense. It is CIVIL.

Second...Where in the holy hell were you an ER tech? YOU of all people should know people are killed almost 10x more than firearms. Vehicle crashes resulting injuries FAR outweigh injuries or medical complication from drug abuse, and the amount of vehicle crashes involving injuries FAR outweighs the number of robberies in this country.

Find a lawyer who is buddies with the judge, so you come out with just a fine. I had jail time removed and just paid a fine with driving limitations to and from work.

The State of Florida dropped my case like it was hot coals when my lawyer informed the judge of the "officer" not being up to date, and not actually clocking me.
the latter was what did it i'm sure. Something about an officer witnessing something and telling it to another officer.

Since he was a civilian" the judges words not mine" he could not go by what the Sherrif told him. The Sheriff clocked me, but the Hwy patrol guy wrote the ticket

Case dismissed.

There is alot to read on Federal Law concerning the States abilty to regulate NON commercial travel.

, Is it a privaledge! ..... Federal Law .....says its a RIGHT not to be regulated by the state. unless its for personal gain.....commerce.

Driving IS a privilege and is NOT a constitutional right... Just because they take your license away does NOT mean they are restricting your right of travel.... They have things called busses, trains, and airplanes these days...

Listen up guys.

This kid made an error we all have done. ( he without sin cast the first stone)

Working in the Med Field, i saw some horrific things.

This kid on here is worried sick. He hurt no one, nor did damage to anyone/thing. i'm pretty sure it has sunk in. keep it at the track!

In regard to the Constitution, You may want to recheck you facts and case law.

I'm no lawyer. But to me it seems upto some interpretation. Good thing we have the Supreme court.

Just google " Federal Law is Driving a Right?"

To the OP. yes you did wrong, we know you know that now. It won't happen again right?

thats really what the state and police want.

So its safe to say( to the OP) you won't be doing 100 on any city or hwy roads right? and obey the speed limit.
