already posted in the general auto discussion forum... sucks that the dealership is being so tough on the guy and won't just admit their mistake and man up and sell him the car for the price.

The dealer is not required to sell it for that price. According to Ebay, auto and real estate auctions are non-binding bids and do not constitute a sale. The auction put up by the dealer said that bidding on the car was a binding contract, per themselves, to purchase the vehicle. However, the text did not include "for the final auction price". So since there seems to have been an error in the reserve price they can probably get out of the final auction price. Unfortunately this causes bad PR and will probably hurt future sales.

The bidder wasn't someone unfamiliar with Challengers. His join date on www.challengertalk.com is December 2008. Its not as if he was unaware this price was way too low. So now a sales person has to take a large hit and whoever else gets paid for helping with the sale will be out money (MSRP on SRT8 is over $40,000 and this one comes with options) just because this guy wants to stick it to a dealer for an honest mistake? He should make a compromise and cough up another $6,000 and still get an excellent deal, and the dealer breaks even or is maybe out $1000 instead of $10,000+.

So if they guy makes an honest mistake and bid $40,000 for the V-6 version you don't think the dealer would stick it to him? The ebay page said that the Seller is responsible for all listings on the page and the dealer stated the bid was a legally binding contract. The dealer screwed themselves over in this one. It'd be much easier for the dealer to eat it then lose a lot more money on lost future sales.

If that had happened, he would not have to pay $40,000. When you put in a bid on ebay, you put in your max bid. If your max bid is higher than someone else's max bid, then it puts you at the minimum increment over that price. And I think an honest dealer would let you purchase the vehicle at the correct price if the auction was inflated with bogus bids.

Yes dealers take advantage people, which is part the persons fault for not understanding everything they sign for, and part dealers fault for pushing it on someone that doesn't understand. But this is not the case. Unless someone has a hands on account of buying from this dealership, then no one can attest that this is a shoddy dealership. People make mistakes, and if this goes through then you know someone is getting fired from the dealership. Who wants a car at a great price at the cost of someone else's job?

If the bid was on E-bay then no the dealer wouldn't and couldn't. Buyers retract bids all the time from accidental bids on E-bay. There is NOTHING a seller can do to force the buyer to pay an accidental bid. There are polices in place for such circumstances just like there are polices in place in circumstances where the seller accidentally posts an auction incorrectly and the item sells for cheaper then intended.

And fyi, auctions for autos and houses on E-Bay are NOT legally binding. Getting a lawyer in such case will result in him just wasting a ton of money on a lawyer for no gain. He will end up fighting E-bay over their policies that allow the dealer to back out and not the dealer itself.

Just saw on another forum that this guy got his Challenger, the dealership honored the auction. Good for them!
