Hello again all,

My g/f has provided more perspective on the matter and has some questions:

I spoke with lady on phone from this Subrogation Department and she said, if hypothetically I did settle for that original $5k amount then, she knows it wouldn't be fair to ask for the full $3,375 amount. According to her, she would negotiate with me on how much they would take from my pain and suffering settlement.

I never signed the paper to settle for $5,453 as I did not think it was fair to pay the rest of Chiro bill. Yes, the chiro bill is way higher than I expected it, so, I am attempting to get the Chiro to lower this left over bill that is due.

Here is list of expense:

Car repair paid: $3,614
Chiro bill: $4,295 so far my side has paid him $2,941 so $1,353 is still owed

My Question:

Is it unethical or illegal that the other side was ready to settle with me for $5k in October but then at last minute in November, I got this letter that my insurance wants $3k from this settlement? Since, both I and other party have Liberty Mutual insurance, are they more able to screw you over?

Shouldn't "my side" of Liberty Mutual inform me ahead of time that they were going to take money from my pain and suffering?

* If I would have known that "they" (meaning my Liberty Mutual insurance) were going to take money from my pain and suffering, then I would have asked for a lot more than $5k.
