Agreed, Ask for all the files. Most likely they will fail to present said evidence and will throw the case out. Had this happen Twice when i fought tickets.
If you want the "files" you will have to serve the LEO agency with a "subpoena duces tecum" well in advance of the trial.

Sorry bro, but Calf is broke. Our saying in Oregon is, "Go back to Calf, if you are going to bring your baggage with you"..........turns out, the best are leaving Cali for anywhere else, leaving only old relics like Gov Brown to run the place to the ground.

To all those who say fight the 500, what if you get found guilty? Court costs and penalties on your license are far more than that. Don't fight it. Plead guilty on their first offer on the trial date. It's the best offer you will get.

Love all the advice to help you weasel out of the fine, but hey, were you guilty? If so, suck it up and pay your fine.
Im not going to try to fight the ticket i know i am guilty i was speeding. It wouldnt be worth to take time off work got to court and who knows what would happen. The area i was driving in is real easy to speed i drive 680 alot and the average speed in the area i was stopped at is 80 when its not full of traffic. I was going with flow of traffic but i have a new shiny camaro that prob sticks out. I think the fine is outrageous but i know the chp have to do there job.

As far as I know, CHP does not mail tickets to violators. The courts will mail courtesy notices to violators who were issued citations personally by the officer.
Do you know the name of the CHP officer that issued the citation to you? One who works the I680 beat was killed recently. Obviously not trying to take advantage of his death but anyone who received a citation from him should contest the ticket to get an automatic dismissal.

I tried to fight a ticket one time that i know i wasnt guilty of. I plead not guilty and thats all they offered me was community service or pay the fine. I told the DA or whoever that took me in a lil back room of the courthouse he said "look your gonna be found guilty no matter what so you either pay or do community service the officers are trained to know how fast you were going". The officer said i was speeding because i was in front of other cars he was a real a**hole. I was in front of the other cars because i pulled out in front of them from a side street. I was in my old 4 banger toyota work that barely went 40.

Yeah thats not the officer he was there when i got pulled over but he wasnt the one to write me the ticket. He came a min after i was pulled over there was a car pulled over a few feet in front of where i stopped that was broke down. I think he went to ask the driver whats going on. The morning he got shot i told my gf i recognize his face because he walked by my passenger side and bent over looked in my car and just kept walking to the car ahead. I did think about that when i first heard on the news a chp was shot in walnut creek.

I think that should be a violation of your rights for them to put cameras hidden everywhere like that. Wheres the freedom at if big brother is watching over your everymove with cameras.

I'm 67 and at one time Montana was wide open and they would give you a ticket if you where doing over 85 or so and then it was just a $5.00 ticket you paid on the spot and it never went on your driving record. I had 6 in one year. Other than that one year I've never had a speeding ticket and I know I need to slow it down NOW. I'm sure if I had a V-8 it would be all over. Damn the V-6 has plenty of power in my book and yes I got up to over 100 mph again today. I passed a couple cars today and it's amazing how quickly you can reach a 100. I don't miss Calif. since I grew up out there, OPPS I lied I just remember I did get a Damn ticket in this town going 37 in a 25 and it cost me 199.00 + yes I did a 8 hour driver school course for $50.00 and it stayed off my clean record. How exactly do they prove you were doing that?

Seems like a lucrative scam to me. send people tickets in the mail claiming they clocked you so long ago doing this or that...

psh.

First trial typically is whether you plan to plead guilty or not guilty.

After this then yes you will have to ask for said files...

I like to draw trials out. A better chance of either the police officer not showing up and/or said files being misplaced.

Cop does not have to show for court on a mail ticket. It's a civilian employee who reviews the facts and mails it to you anyway. Usually, this is a person who works for the court (jp or municipal) and is in the building already for daily work.

NEVER in my life have I heard of a hand delivered ticket from the officer. Citations are only issued under the JP of the area. Works that way everywhere.

Best bet...go...plead guilty for some community service or a lower fine. Don't try to fight it because you already have it in your hand. Now the proof is there that you saw it (unless you want to lie under oath that you didn't....DONT do that....). The only fighting chance you have is against the equipment...not the officer. That's where most people screw up. If you really want to fight it, find out if the unit is certified. If so, when was it last certified by the department? Is there a log of tuning the unit daily? Things like that. Does it work? Sure, but not often. More often than going to court and calling the cop a liar though. That never works...

Here in DE they have the stop light camera tickets (for now...no speed yet)..but I can tell you since its a civil violation...... the certified mail thing doesn't work either.....if the fine or the civil ticket is not addressed, then they attach a cancel flag on the registration to the vehicle...so when it comes time to get your tags renewed---- you can't do it until the violation is taken care of.....gets people jammed up all the time.

that may work in certain situations.... until you get a ticket from an officer that works for a department where they suspend the officer for up to 8 hours for missing a court appearance. I'm not giving up money for anyone I can tell you that. or worse yet....you end up pissing off the officer enough that he won't cut you any breaks at all and decides to slam your pee pee in the courtroom door...so to speak LOL

I figured it would be around 300 Im lookin at about $500 when its all said and done. I dont know about other states but ca is getting ridiculous with there fines!:upset:
Just send them a picture of $429.00 and see what kind of response you get.
