ha this is going to be a headache tonight, but me and my lawyer talked last night, he told me be polite see what they say and not to worry, i will "sew them to kingdom come, if i have to" where his exact words.

do you still have the origional parts from the mods, exhaust manifolds, intake? maybe you could give them back the parts, Chevy could swap them out so Ford gets the origional car back, then Chevy can sell the Mod parts to recoup the tradin price they gave you with mods.
Since the Ford was leased, i might have removed all the mods and went back to stock before trading in. better off selling the mods separate, since the dealer would never give you good trade in value for them.

looks like this is turning pretty nasty--- After the meeting, i did not have any options like they said i would, basically they want there camaro back or want to charge me 410 a month rather then 295 a month, (due to the fact my mustang will not be considered a trade anymore) on top of all that, they want me to return my mustang and get stuck with the fines i get for all the mods (unless i get a ford, which i dont want)... my lawyer is on this case at the moment and basically i will lose this fight INSTANTLY if in my contract with the ford mustang it states "you MUST return this back 2 a ford dealer", if it does NOT say this, then i have a fighting chance and blame there pure stupidity and keep my camaro... but till then i am driving my camaro for free without any payments thus far, been a month and a half... but if i do lose this case, i wonder how many burnouts can possibly be done before my rear tires vanish-- HA--- pretty bummed.

This thread shouldn't have been three pages. I hate to tell you OP but this is your fault for not knowing how a lease works and not reading your contract. I believe the chevy dealer also shares in the blame in the respect that they should of known better. I don't know how you or the chevy dealer could think you could trade a car that you don't own. I hope your lawyer can help you somehow ,but ultimately it looks like your fault the way I see it. What a mess.


I do however believe you should change the title of your thread though because it's misleading. I don't see how this is Ford's fault in any way.

Did you actually believe you were paying to own a "leased" car?

The simple fact of the matter is that car was Ford's. You were basically renting it.

I don't know for sure, but I think Ford could actually come after you for the car. I went with a friend today to have his F-350 serviced and I talked to the finance officer there about your problem. He said that all Ford Lease paperwork is the same, and it does state that you must return the car to Ford. Here are the options:

1. Return the car at the end of the lease
-Incurr penalties for possible over milage, mods, damage, etc.
2. Purchase the car after the Lease is over
- Pay cash for remaining value
- Secure financing to purchase car
3. Trade car in on another vehicle (Ford) based on value of car.

Unfortunately, the others are correct. With a lease, Ford owns your car. You are renting it from them. Now what could happen if the Chevy dealership wants to get nasty is that they can demand your camaro back and charge you for wear and tear since now it can't be sold as new (including tires...) since you messed up and traded in a leased car. True, they should have known to ask questions, but ultimately you are responsible for understanding the contract for the leased vehichle, not them.

Also, when you lease a car, Ford, or the manufacturer keeps the title. So in order for your chevy dealership to sell your mustang, they have to get it from Ford. This could be another problem for you.

I see you are in chicago. What dealers were these?

Also, Why would you modify a leased car? Unless you planned on buying it at the end of the lease.

Good golly, where to start with ALL of the mis-information?????

This is done tens of thousands of times a day. The Ford dealer is being a tool about this. Here is how it works...

The Chevy dealer calls up Ford Motor Co. (or the leasing div.) "we are purchasing this car, vin # XXXXXX." Ford " okay send us a check for, $XXXX.XX" Chevy dealer, "Okay, I'll let our title clerk know. Thank you and have a great day"

You can trade a car leased, owned, or still making payments on it. In a lease you have to fulfill the lease obligation. So if this was a 36 month lease, and he says this mustang sucks I need a Camaro 12 months into the lease, the payoff for the lease is 24 months of payments AND one of 2 options; 1) they can pay the residual value, or 2) they can negotiate a lower amount with FOMOCredit.

Ford "Could" have in thEIR agreement that it has to be turned into a ford dealer, I am fairly certain GM still does as well. Sometimes it happens, sometimes it doesn't.

The fact of the matter is, the Chevy dealer who agreed to this whole thing....agreed to this whole thing. Now several weeks later they have discovered an error on THEIR part, and want someone else to be responsible for THEIR error. I wish someone would take responsibility for all the errors I make and I could get a do-over so I came out ahead.

Regarding the "ownership" of a leased car. Yes he can do WHATEVER he wants to it. THERE are caveats; it may need to be returned to original condition. Meaning, he can't cut the roof off. However, he can make modifications, and the dealer CAN accept them. that is the same case for a car he owns. The dealer doesn't have to accept a car with modifications, and the last time I checked, the dealer doesn't have to accept a trade at all. In fact I think, at least in Illinois, they don't even have to sell the car the buyer wants to buy.

To the OP, the chevy dealer has assumed the lease. If they want to turn their car into the Ford dealer they have every oportunity to do so.

shifty6 thanks for all the input--- i def agree with that--- i may just refinance the mustang so long as chevy promises to buy it with a written contract- that way they can have that car and sell it- if thats what it takes to get rid of this headache i might just do that-
