I absolutely loathe drunk drivers. One of these days, the offense will truly be considered a felony and apply to the three strikes and you're out law, putting these douchebags in prison for life.

Three strikes my @$$. ONE strike is too many. You make the choice to drink without an alternate means of getting home, you set yourself up for having to drive drunk, and in your drunken haze you take the only option you've given yourself.

It's a premeditated act if I've ever seen one. That does NOT deserve 3 strikes.

She was riding her bike home in the evening along a country road and a drunk driver clipped her and knocked her into a ditch. She spent the next 5 hours dying in the ditch because this low-life never stopped. The next day they found her and found this guy because he had a bent up fender with her blood on it. This guy should have been in prison for many years, but got out after about 2.

I'm all for a 30 day minimum sentence for the first offense, escalating to a 6 month minimum for the second and a 5 year MINIMUM for the 3rd (or in three strikes and you're out states, life). To me this is realistic, though to be honest I don't disagree with making it even tougher like you said.

I think we're thinking of two different scenarios. I'm talking about if the first offense includes an accident with injuries or death. I am getting the impression you're talking about if they're just pulled over and blow over the limit.

With the guy you mentioned, I'd have been the one in jail if I found his fender like that because the cops wouldn't have arrived in time. (Though I would at least call them and give them a fighting chance.)

Yes, my scenario is for a typical drunk driver being pulled over.

Oh, and unfortunately a second kid just died due to this.

we had a drunk driver here in phoenix 2 days ago. 3 times the legal limit, and driving the wrong way down the freeway. Actually posted on his facebook page how good it was to have a drink. And i think he was in his 30s. A cop saw him, and blocked the truck with his own. Fortunately he was okay. The guy ran from the scene, but was caught.

It should be one and done for drunk driving. First offense - year long license suspension plus mandatory car impounding (so ppl dont just drive with a suspended license).

And I don't understand why we can't have a 10-year minimum sentence for killing someone while on the phone, texting or driving drunk

5 year minimum if someone is seriously injured, 10 year minimum if anyone is killed. If someone put a prop up here in CA, I know it would sail through no problem. Driving's privilege NOT a right.

My ex-girlfriend was killed by a drunk driver. We had been broken up, but still I was saddened by that.

The guy that did it wound up dying in prison.

All too often the drunk drivers kill someone else, and not themselves.

sad stuff- when you comment an illegal action that is notorious for putting lives at risk, such as drunk driving. and it causes a death.. The punishment should be VERY HARSH.

I'm tired of rapist, child molesters and DUI w/ serious injury/death offenders getting off so lightly.

a lot of states are currently working on incorporating new laws to include this. South Carolina has a new one for "Driving while In-text-icated"
and it holds the same punishment as a DUI/DWI
