What's a fast lane? No such thing.. In any State.. In all States the posted limit applies to all lanes.. all the time.. No lane gets to legally go faster than any other lane. PERIOD.


now if you are referring to the far left lane being a passing lane.. well ok, but only one state has a designated passing lane, the other 49 do not, this isn't Europe.

several states have enacted laws requiring people moving slower than the flow of traffic to stay to the right:

Illinois
Kansas
Kentucky
Louisiana
Maine
Massachusetts
New Jersey
Oklahoma

All of these States have very specific laws that say you must stay right if you are travelling slower than the flow of traffic, but NONE of those States give anyone the right to travel FASTER than the posted limit in the left lane or any lane for that matter, and none of them specifically call out the left lane as a passing lane.


However Colorado.. This State passed a law in 2010 I believe that calls out the left lane as a "passing only" lane if the posted limit is 65 or higher.

However, it still does not give you permission to break the speed limit, only to pass to go around someone moving slower than you, and NO ONE, can stay in the left lane other than to pass.. and it's a $500 ticket if you do.


The term "fast lane" is a very misunderstood nomenclature, that actually got it's start meaning that the far left lane tends to move faster than the rest of the lanes because it is not an exit lane, and you can't merge into it. It has NEVER had anything to do with being able to travel faster than the posted limit.
Technically, in Mass, you can't travel in the left lane. It's a reason to get pulled over.

Heya. I got your pm and while I was going to reply to you in PM, I wanted to reply here in the thread so everyone else knows as well that no, I'm not offended or mad at you. I'm just concerned that too much info is being posted which can get others in trouble.

We all get tickets. Simple. It happens. Heck...I got 17 tickets by the time I was 21. In fact, it kept me out of the dept for 3 YEARS...because they had to clear off my record as I was viewed as a liability. After 10 years on the job, I finally had an accident...at 3mph, I hit a pole in a parking lot which I didn't see because the pole was on the other side of the A pillar. My fault. Sucks. But my point is, I've had 17 tickets. I paid a lot of money getting them taken care of.... ugh... ALL were my fault but one. The last one I got in Cuero, TX by a DPS guy was total shit. I have three witnesses who were with me and they all knew it as well. I won't got into it... But what can I say? It's way in the past. We are either at fault and we know it and own up to it or we aren't at fault and we take it to court and get the ticket cleared.

So yes. I know we get mad. We screw up. We get caught. We all want to vent. There's nothing with that. But venting and then saying we want to get out of it posting who's going to get you out of it, etc isn't cool. It makes you look bad. With the previous posts, I think the majority of the people here saw the same thing.

With regards to the guy using foul language, if you feel you were wronged or disrespected, you can always call his supervisor and complain. Or you can call IA and file a rudeness complaint with them. Now, if you are going to get your buddy to call the citing officer to try to get you out of the ticket, I'd obviously not file any complaints. So if I can offer a bit of advice, smile when getting pulled over and be nice. That can help out a lot during a stop. If the officer is rude, remember...99% of them have video/audio. If you've given him no reason to be rude or use language as you described, a complaint can be filed and the guy gotten in trouble. But being nice deescalates the heightened aggression which the officer might feel. As he comes down, your chances of getting off with the ticket also go down.

Example.

I was behind a truck on a 4 lane road with a grassy divider. I'd been behind him for a while and we were now stopped...no reason he couldn't have seen me. Truck, from out of nowhere, decides "I'm going to make a U-turn over the grassy median right in front of the officer. Yes, this resulted in a traffic stop. I was headed somewhere to help an officer and now this schmuck decides to go and do something stupid in front of me. I DO NOT WANT TO STOP THIS GUY....I HAVE CRAP TO DO. But I have 40 other cars around me and everyone sees this guy do this. So I go and pull him over. I walk up and ask, "what the hell are you thinking?? Did you not see me behind you?" He looks at me like, "what's this guys problem" and replies, "excuse me? Are you ok? Why are you mad? Why are you yelling?"

I stopped and thought...

So I deescalated for a second and replied... I'm otw to help an officer. I have to get to him. I saw you...bla bla bla...and no, I don't like writing tickets. I've had plenty in my driving time and no, I don't want to have to stop you and give you one. But here we are. So yes, it makes me upset that some people don't care about traffic laws and will go and do things right in front of us like they don't care.

I know most folks don't have cash to throw around on BS tickets they'd rather not get. I know I don't. But if you knowingly break the law, suck it up and deal with it. I had to....17 times....even with one of those NOT being my fault.

So no...not mad at you for anything but am very concerned for your buddy Rich and obviously for the guy that wrote you the ticket. If I were you, I'd call Rich back and tell him to not worry about it. While you posted about it, any one of these thousands of people on this site could have already gone to the Elisabeth PD site, contacted the PD, found Rich and the guy from his academy class who wrote the ticket, and advised them of the thread. Just let it go this time and use it as a learning experience. If I can offer my .02 cents, that would be it.

Again, ok to vent. But do so respectfully and tactfully. Bueno? Awesome.

Some people that drive too fast learn too slow. I've had 2 speeding tickets in 44 years and none since 1977.
