Believe me it happens daily here in the DMV. Hell some D-bag tried to do it to me again this morning as i was headed in to work!

I suspect he moved left to try to get out of your way as you moved into his right of way, but had to move back due to other traffic.
Thats easy to say but thats not what happened in this case.

All four of my tires were in the lane already and as i said he accelerated and went left then right into me.

Lol. Ok. You asked for opinions from cops about fault. My opinion is that it was your fault.

Why even ask if you are going to dismiss the answer??

I'd love to hear the other side of the story.

So he was maintaining a safe following distance until you pulled into his lane?

also, just wondering, any reason to get in the middle lane? was the right lane a exit lane only?
Yes it was an exit lane about 200Meters down the road. And yes everyone was going slower due to this was rush hour end of day traffic.

well, it may have been his fault (intentionally hitting you), unfortunately, it looks like yours.

I plan to challenge that though. Laws change when people dont just accept things just because its in Black and White. I understand your position on this based on your position as a LEO. I spent a lot of years (26 to be exact) enforcing rules and regulations myself based on my position and rank. But there were times when rules and regulations actually changed based on the fact that they were challenged.

This happens to me all the time. Other drivers are d-bags. They're always in a big hurry until they get in front of you and slow down.

So you had enough room to speed up and chose to merge with traffic going 15mph faster?? I wouldn't have let you in either. It's most likely your fault according to the insurance. You merged into his lane without increasing your speed to the flow of traffic. That's like the 2nd most hated thing on the road besides not using a turn signal.

Or drive a car that obviously has Blue tooth yet still have a phone up to their ear and cause like a 20 car length space between them and the traffic in front of them because they didnt notice traffic started moving like 5 minutes prior...lol!
