Maybe this will help. The Uniform Commercial Code was adopted by most states, and specifically Article 2 which covers these types of questions.

§ 2-509. Risk of Loss in the Absence of Breach.



(1) Where the contract requires or authorizes the seller to ship the goods by carrier
  • (a) if it does not require him to deliver them at a particular destination, the risk of loss passes to the buyer when the goods are duly delivered to the carrier even though the shipment is under reservation (Section 2-505); but
  • (b) if it does require him to deliver them at a particular destination and the goods are there duly tendered while in the possession of the carrier, the risk of loss passes to the buyer when the goods are there duly so tendered as to enable the buyer to take delivery.
I would pay particular attention to (b) the risk of loss passes to the buyer when the goods are there duly so tendered as to enable the buyer to take delivery. This is where lawyers earn their money arguing over the question were the goods "duly so tendered" and tendered "as to enable the buyer to take delivery." Tough question in this case. I believe hysonmb is absolutely correct that all UPS packages may carry some sort of insurance. I'd see where that route takes you first. Then pursue any faulty that UPS or the seller may have that would assist your argument that the goods were not duly so tendered as to enable you to take delivery. Good luck.

Yeah, I also don't see what responsibility the seller has if the merchandise shipped to the correct address. What did the seller do wrong?

Thank you all so much for your input! Much appreciated. I guess this is quite a sticky topic and a difficult one to resolve in many cases.
I have finally had some good news! The package has been recovered after 14 days of being delivered four units away from our offices. So,UPS was defo to blame here although they continued to insist they delivered to the exact address provided!
The seller was a great guy and assisted through out the ordeal!

If you did not ask for the package to be insured and the seller did ship it as you state that UPS delivered it (to me its stating that UPS had your package in their control). Then I don't see you being able to blame the seller for lost merchandise. My advice to you is to call UPS immediately and get a claim going right away. I had this same instance where on their track and confirm website it said it was delivered, but it had not arrived. I called the office and within 30 minutes it was at my door. IMO for who is at fault between UPS and yourself. UPS because they "may" have lost it and you for not making sure the package was insured. Good luck though and hope you get your package.

If you have the tracking number, you can do your own trace online. Talk to UPS to see what your or sender's options are. Maybe their GPS tracking can match up to the delivery time and see where it was actually delivered to, Wrong address maybe

Just curious, how did you pay the seller? Did you pay with PayPal? If you did, you may have a claim with them. Check out their Safety & Security page, here is the link.

This is not a commercial for PayPal, but I have been down this road before and have found them to be the safest way to go for both the buyer and seller. Good luck, I feel your pain!!!

I have been thru this with UPS. They will never admit fault!!


I had a package delivered to wrong address, with no signature. The driver lied and said she left it at my shop. I was there during the time she recorded the delivery and she was not there. I called UPS 1-800 # and filed a claim. UPS then sent investigator (local manager of terminal) to my business and grilled me. Vary arrogant SOB and actually told me he suspects I have the package as his drivers don't lie. After that instance, I called the company that had sent me the auto parts and told them what was going on. They were a big UPS shipper and they filed the loss complaint and sent me replacements, even though once delivered they are no longer responsible. Value of lost shipment was over $1000.

Weeks later I get this call from a lady who lives on the same street 3 blocks away, on West 12th and I am on E 12th. She says she went into her garage today and behind the door she finds a big package with my name on it (finds name address in phone book) and has no idea when it got there. She tells me UPS never comes to their place and wants me to come and get it, I tell her I can't. I detailed the problems I had with UPS over this package and that she should contact them and complain they left this package in her detached garage. She says she hardly ever goes into the garage.

I had gotten my replacement auto parts by then. Last I ever heard of the subject.

UPS is the worst IMO, i know the on this OP, i got a box from the same guy that UPS dropped off 2 doors down and across the street, and the tell me i got the box and i side i did not, i got other things that day from them but not that box, then they call and tell me it 2 doors down and i need to go get it, i told them i did not sign for it and that is there job.

They that day dilliverd me a box for some one up the block from me there the worst.

I think they deliver about 1.3 million packages correctly a day... sound like the PERSON on your route Ofer sucks extra.. :-)

I paid through paypal but as per the title of the thread,I needed to get opinions from members to know if the seller could have done more or should I take the hit.
In all fairness,the guy is an honest,upstanding seller and assisted through out.I didn't want to jump the gun and get claiming through paypal. I am glad I got my lights
