They sure dropped it quick. I pleaded not quilty on speeding and told judge what happened. He promply dismissed it. And released my car form impound.

He didnt do it because he's a nice guy. He was looking at his computer screen for a few moments before he dismissed it. Normally if you plead not guilty they set date for pretrail. He just dismissed it outright. What other story do you need to hear. Very simple.

It will be a tough fight to get the towing charges, but it's kinda cheap to file for small claims court.

Judge probably dismissed it for several reasons.
1. You were already monetarily punished and inconvenienced
2. Judge knows something about the background of the officer involved and wanted to avoid further litigation and liability exposure to the city and county.
3. Judge knew the officer exceeded authority and wanted to avoid testimony in court that could have been used against the officer.
4. Dismissing was judge's way to placate you and feel as if the situation was resolved in your favor.

Cop sounds like he has Barney Fife or Badge heavy Syndrome. If true, cop needs retraining or dismissal.

The tow charges are only 130 plus tax including storage. i would rather this young cop just be repremanded for his overzealousness. Someone needs to sit him down and have a come to jesus meeting with him. He is suspossed to use his judgement on when to pursue matters further and when not too. He made a poor judgement call and that is that. i will write a letter to the courts and also to the local paper. Im gonna drop it. It will get me nowhere.

If the Officer is grossly negligent in what he did, it is a good chance it can get awarded if he could prove he lost money because of it (Ie time off work). Also, do not believe everything you see on tv.

That is so true. I never realized how much or little for that matter a cop was actually paid until one became one of my best friends. My heart goes out to you guys...or most of them....you really have to love your job to do what you do!

Glenn, Glad things went ok in court for you and it was dismissed. At least your camaro is ok!! Thats the important thing!

He towed your car from your driveway? I have to think that at some point some of the more seasoned guys on the force will shake the rookie out of this guy, sadly that doesn't help you much.
I had a similar problem way back when with a local overzealous cop, I went and requested a meeting with the chief, explained my situation, as well as the fact that I have never been ticketed, arrested, handcuffed (by a cop), nothing of the sort. He said he would see what he could do, forward a few months and the cop was let off the force for doing what he was doing to me to someone who was a higher ranking official in towns wife. By the way after my talk with the chief my troubles stopped.

For what ever reason he decided to pull out his weapon, I am positive his supervisors have already reviewed the case and set things straight with him. It is standard policy to review every "use of Force" and most departments consider pulling a service weapon use of force. If you feel you need to be vindicated file a formal complaint, it will stay in his personal file and be looked at when it is time for his review or a promotion.

Pulling his firearm?? Use of deadly force probable, FOR WHAT? I'd really push the issue with this moron. He felt threatened? I see nothing that even comes close to that here. WTF. Sounds like you got a hair trigger guy running around in a police car in your town. My god, what ever you do don't get caught by him taking a leak on the side of the road or behind a building - he might really feel threatened!

Judges will dismiss cases more than half the time here in Orlando, if the owner already paid a substantial amount of fees as you did or will do for the impound charge. The impound charge will generally out weigh the cost of the any citation.

The fact of the matter is there still seems to be a lot of holes in the story. Little details like, did you get out of the car thinking the cop wasn't stopping you or because you were home and he flipped... far too much to judge...

If I had to take a stab, It seems like the cop was overzealous but at the same time... missing way too much information.

Most Camaro5 members are sensible people... as such, it is hard to point blame on someone who cannot defend themselves here. That is why your first thread was closed... it is why THIS one will be closed eventually because some people just cannot handle a calm, respectable conversation.

You seem like an honest man who got tied together with perhaps a cop that misread or had mis-communication with you... either way, we will never know because he can't tell us. If the judge dismissed this case without setting a hearing date subsequent to the charge, chances are he felt bad for what you went through... not that he felt you were "innocent".
