sounds like some of you guys have it rough. I rarely see police in my area. We have a pretty serious shortage around here. On the strip, the speed limit is 40. But it's a big road and if it's clear I will do 55. Never had a problem. And I do between 80 and 90 on the highway. Just because the highway is so boring and I want the trip to end as soon as possible.

I'm not one to start or continue a confrontation w/ a business owner. It's their business and they are the property owner. Let's take...I don't know...a fast food restaurant for example. I'm at the edge of their plot on their property. I'm not blocking a driveway nor getting in anyones way. I've never heard of an owner getting upset because we're running radar from their lot. In fact, it's just the opposite. They want us there for safety. They feel security w/ us being in the lot. No one's going to run up to rob the store. No one is going to start problems w/ employees or other customers while we are outside. No one is going to break into any cars while we are there. They like us there. (although it does rarely happen that a problem occurs while we are outside)

But, in the instance that someone wants me to leave, I'll leave out of respect for the owner. Let's take a bar for example. If I'm sitting in the lot, what's going to happen to the bars business? Most likely, a small percentage of the patrons might not come in. Some of those patrons might have warrants, past problems w/ the law, or be afraid to drive home in their car if an officer is outside. The bar loses business. The owner gets mad. He tells us to leave. We leave. I wouldnt' sit in the parking lot anyway. But, the owner complains to the sergeant who advises the officer not to sit there anymore due to the bar losing business. The officer won't sit there any longer. It's that easy.

But, I have respect for business owners and don't want them upset. If I ever were to be asked to move, I'd say, "Sure. There are plenty of other places I can go to run radar. I'm sure they'd be happy to have police presence in front of their store deterring crime and speeders from their area." I wouldn't tell a business owner to scram or be arrested...that's a little out there.

That makes since.

Let's change the scenario. Let's say you're at the mall. A cop, who is not scheduled for mall duty just finished up with an earlier situation and is preparing to leave. Now, the posted speed limit is 15 mph and I'm doing, say 20 as I drive by the officer. Can he stop me and issue a ticket? If so, can I contest it in court? Remember, this all takes place on private property...

AHHHhhhhh....I think we got mixed up w/ the whole issue! Maybe I misunderstood and I apologize. No. We can't enforce ANY traffic laws ON private property. In other words, if you are speeding ON private property, I CAN NOT stop you. Actually, I can. But, I can't write you a ticket for speeding. I can give you a criminal tresspass warning if mall security, management, or other person working in place of management wishes me to do so. I, or the person, issue you the warning and send you on your way.

What I meant, was I am sitting on private property running radar at people who are passing by on a public road. That is okay. Running radar on private property? Heck no.

The only two laws in the state of TX we can enforce on private property are:
1. Driving While Intoxicated
and...
2. Reckless Driving

All other laws pertain to a public roadway. Sorry bout the confusion!!!
