I'm a licensed Realtor....you'd have to prove the previous owner had knowledge of the defects and besides that - after five years you're pretty much SOL. The only way to get a "perfect" home is to buy a brand new one with a warranty. Obviously there can still be issues but it very could be that the previous owner didn't know of any defects. After all - you didn't spot them, the realtor didn't spot them and (let's hope you got one) the home inspector didn't spot them. Just one of those things unfortunately.
