If you get a decent judge he should dismiss, but the cops were right in the fact that you met the statutory requirements for impersonating a police officer. No matter the level of fear you are in it won't justify identifying yourself as a cop. Funny thing, it probably would have justified you using force to defend yourself...even possibly deadly force if they were in the act of inflicting bodily harm...but still would not warrant you to ID as a cop. My guess is they were not 'gang members'. They were probably sh-- biscuits trying to act 'hard'. If they were really gang bangers and saw you were unarmed and out of uniform saying you were a cop may have actually made it much worse...

Basically in our state (i know it may be different in yours) reads something along the lines of identifying yourself as a police officer towards a civilian and the civilian's actions being altered by your statement or exhibition of badge/lights/siren so on....

Yours is a very weak case...from what it sounds like to me the officer wrote a report, but you were not arrested? If you were not charged you have nothing to worry about....if they refused to give you a crash report for the damage (if any) to your car ask for a supervisor...if the supervisor fails to provide you with one...you will either have to just pay the damages yourself or get a lawyer to press the police department or guy who caused the accident.

...and yes it is a felony. Generally I do not charge people with this offense unless they have blue lights in their vehicle pulling people over or in full apparel....while yours meets the requirements, it is very weak....if you aren't being charged just relax
Thank you sir. I really appreciate let me know this is. It does make me feel much better. Im still shaking from the incident sense I havnt been close to danger like that and alone on the wrong side of the town. Its true what they say " In the wrong place at the wrong time" and yes sense they didnt arrest me alot of people were saying it was too weak. But thanks for the information!

not for nothing,, but there is no deductable when its someone elses fault.. its the other guys insurance that pays. why should he have to pay for someones screw up. as far as the cops being late to arrive and not writing the other driver?? not right,, but they have to write a report. i have several friends on diff forces,,sheriffs, state police, local,,, u did what u had to do,,maybe just chalk this up to experiance. i would however have been pissed myself about the car.

Ya they were an hr late and I even told 911 that my life is being threatened and it still took them another 15-20 to arrive. I honestly think APD doesn't care about the safety of its citizens

If they were real gang members and you told them you were an off duty cop that might make things worst...I NEVER tell anyone I am a FLEO when I am off duty, and if I ever have to let someone know I am in law enforcement, I am carrying.

Well .. Being an ex-cop ... what happens is the street cops only are "report takers" .. then they have to hand over to a Detective who will investage and it's up to the prosocuter to determine if there is enough evidence .. then it's a Felony which will then mean it will need to get past the Grand Jury to see if they even want to indite you .. then if they do ...it will go to trial ... I strongly doubt it will ever go that far .. A Lawyer will get you off with no trouble what so ever with your perfect record and they know that. don't even worry about this you'll be ok... there are real criminals out there ... If you said this for your Safety and not to commit a crime or hold someone against their will (like the other post says.. unless your pulling over people or commiting a crime)...then don't even lose any sleep over this... Your not going to be in any trouble at all.

Contact the local media ... sounds like this isn't the first time something like this has happened at that establishment? In Missouri we have conceal and carry!

I don't think any PD goes to any noninjury car damage call anymore. The idea is that you must have been injured for them to come. Phone statements they appear to be drunk, your thumb is injured, they have me in fear of my life, might have a better response from the PD.

You don't have the right to keep or detain anyone. You can state you will be leaving the accident scene. Your right is to observe and report. Use your cell phone camera on them. You kill someone on a non injury collision call........your life will change forever. The pokie might have new meaning about you. Sorry!

You have uninsured insurance for this or collision coverage for the Camaro, it is not worth going to jail for.

Concealed carry ftw. I'd rather kill a man then die a helpless victim. I've been in a situation where if it was not for direct action of another I WOULD not be posting here, or driving a camaro.

I totally agree with you there. I've been in the same boat before. I do appreciate everything our men & women in uniform do and have a great deal of respect for them.... but just remember... when seconds count, police are only minutes away . Always good to have my 2 best friends at my side Mr Smith and Mr Wesson
