Look, according to the rules as they stand now, it was a penalty.
Even Lee himself said that his head didn't hurt...and that he just couldn't breathe (ie: getting hit in the chest). Most of the hit WAS with the left shoulder. If you watch the video replays on this (and I have), Tate's head twists right. If he had only hit with his helmet, he would have broken his neck. When you get knocked in the chest like that, your head is going to whip forward. Was there contact with the helmet & chin at that point? Yes, but I still say it was very incidental contact to the head ESPECIALLY considering Lee's comment after the game. It was a VERY hard hit, but unlike other true helmet to helmet hits...this was nothing. It just looked spectacular because of the decleat and sudden change of direction by Lee. If you watch the replay from all angles that were shown, Tate does get his left shoulderpad under Lee's right armpit. Point is, 6 months ago, this was a textbook hit. And, as we wussify football even more we are going in the direction of this:
