I don't want to take sides on this argument but I do need to point out the falsehood of this statement.

Many places it is illegal to let any animal outside without it being on a leash. That means that yes, it would be illegal to let your cat out at night. I'm not sure if the place where the OP lives is one of those places, but there are quite a few of them (I live in one).
