I am fine with them.... if your car is stolen. They find them. If you are suspended, wanted, or have an amber alert, they find you. Many new patrol vehicles are being equipped with auto tag software mounted in the top deck light bar... it has gotten so bad that many cops have to turn them off before their shift ends or they won't go home.

...now the red light cameras... those suck lol. I don't run red lights, but I have taken a few california right turns on a clear roadway and those cameras are brutal on those turns.

Okay, that makes more sense. Like Brantley said though, your tag can be ran at any time. I really couldn't see this ticket holding up in court with the information you've given in the op. Good luck to you.

A few others have asked, but the more I read your post, I have to as well. Why did your friend driving the car leave the scene? Had he remained at the pump, he could have told the officers he was driving the vehicle. From the officer's point of view, the friend driving your car is nowhere to be found, just you.

Did your friend have something illegal in his possession? I just find it odd you mentioned he didn't return to the car when a K-9 unit arrived...

Was your drivers license suspended or your tags or both?

Tennesse just passed a law that allows you to turn right on red without stopping but only at red light camera intersections as long as it is clear of approaching traffic when you get there.

Okay, so you are saying that yes your license is suspended, but no cop ever saw you driving, so they can't say you were driving? Am I getting this right? I guess you should have not gone to the station in the first place with a suspended license. I mean if the same thing happened, but you had a valid license we wouldn't even be talking about this.

Bravo sir...you get it

Again, he may win that charge depending on the judge. The cop will say he saw a young male driver.... maybe he ran the tag before, stopped the vehicle and all we have is OP.

However, If OP gets a judge who actually cares about society.... the judge will demand the attendance of the friend who vanished into thin air. If OP cannot provide that, he may find him guilty based on the officer testimony of him being by the vehicle with no one else around and IF the officer saw the vehicle in motion at any given point.

....also, PHYSICAL CONTROL of a vehicle is driving in the State of Florida. Keys in the ignition (ON OR OFF) with the keys within grasp of the driver....that is physical control. Vehicle doesn't have to be in motion in Florida to be found guilty of driving while license suspended. You can be in a parking lot asleep if you have the keys in the ignition... so for OP to say this was a "low in law enforcement" is rather humorous.

Agree, but either way probable cause still exists for his tags... you don't need a vehicle on, in motion, driving, or in physical control to issue charges on tag violations.

I still find it humorous .... most cops I have contacted love these cars, and don't harass or profile them as long as you do not do stupid s--- or have valid information. Odd...
