The emissions bypass isn't illegal, or lazy. VW had it set up where it could detect when it was on a test station to beat certifications. The FCA system is allowed as it only engages in certain driving conditions as permitted by the EPA and the clean air act, etc.

Where FCA may have messed up is by not disclosing them properly.

The lack of proper follow thru on FCA's part or the willful intent to cheat the system, lazy or cheating will still result in a major problem.

You don't get into trouble, fined or jailed for doing legal emission control systems so we will see how this plays out. See VW.

VW had ILLEGAL programs used to subvert testing.

FCA has LEGAL programs used in normal driving conditions but were supposedly not reported.

There's a difference.

It seems that GM took the time and due diligence to insure there midsize diesel pick up trucks and diesel Cruze sedan were to compliance with the EPA, or at least until otherwise noted.
