(3) he intentionally or knowingly makes markings, including inscriptions, slogans, drawings, or paintings, on the tangible property of the owner.

It's night time. You leave wal-mart only to walk up and see that someone is messing with your car. Naturally you yell at them to stop. The Bad guy turns with something in their hand. In that split second, you believe they may use that item in their hand to cause you serious bodily injury. You draw and shoot.

Are you justified in Texas?

After the police arrive, you learn he had a spray paint can. Does that change what you thought at that moment in time? And does that change the outcome?

This sort of thing happens all time in Law enforcement where they believe the BG had a weapon only to found out later it was a cell phone.

This type antics are dangerous.

Not living in fear.... Just in a state of preparedness.

I have a fire extinguisher in the garage and kitchen. Not because I fear fire. I'm just prepared in case of one.

I have jumper cables and some tools in my vehicle. I don't fear breaking down. I'm just prepared in case I do.


Maybe I don't fear these things because I am prepared.

Some of you fine folks should look up the term "violence of action." It's a term used by SEALS and other special warfare operators and it is all about being as prepared as possible and then acting in such a manner that simply overwhelms the objective. Total dominance over the enemy, bringing to bear everything at your disposal.

Wow this whole thread took a "deadly" turn...see what I did there?

Seriously this is quite hilarious. I am one who will double park (never at the front of a parking lot, always in no mans land) to avoid some dumb..butt parking next to me and slamming the door into mine.

With that being said. I would be beyond mad if I saw that happen but then with the note I would have to laugh. People get their cars keyed bc of double parking. This is a harmless and hilarious prank

you're digging your hole deeper and deeper. pretty sure that "violence of action" is for the battlefield and not your driveway or a Target parking lot.

did you see that story about the guy who shot at teenagers at a gas station in Florida a few weeks ago? Said he saw a shotgun, and killed one of the kids. They found him guilty and he's looking at hard time.

Violence of action is a state of mind. It is about doing whatever it takes to survive... By all means necessary. It’s about not being a victim. This is a mindset that reaches much further than the battlefield.

As for Florida, I do not know the details of the situation and I must assume that the triers of fact are privy to details that you and I are not aware of. That being said, I was being specific to Texas.

Again... Life means more to me than property. That is just my personal stance. My original point is: Don’t mess with someone else’s property regardless of how big of a d-bag someone is, it just might cost you dearly. Do not encourage it. Other may not have enough forethought to realize what could be truly at risk.
