New Gm
l was watching congressional hearings today. Subject about liability came up. lt was said the new G.M.& Chrysler would be responsible for honoring car warrentys etc. but will have no responsibility if cars have defects causing accidents or injurys. Since l think we all know it is almost impossible to sue the goverment , a 60% shareholder in G.M. does it make a difference? They said the dealership would be responsible, doesnt make sense they only sell the product. l dont know if it applies to old G.M. & Chrysler or new or both but a valid question. Ya l know this will soon be buried but had to ask. thanks.

Let's just hope it's a non-issue, I guess.

Um ya....I don't really see how that would work out. If GM vehicles start exploding right and left then I am pretty sure GM would have to do something. Besides a dealer can't afford that type of lawsuit. Sounds like they are trying to pull this off to prevent any future class action lawsuits. I am curious to see how this plays out.

I think that we need to remember that Congress represents the most marketable people that can afford to run for office. In other words, they aren't the best or the brightest. They are among the wealthiest and among the most easy to sell personalities that can win in competitive campaigns. When considering that they could be as dumb or dumber than any of us, you have to open the possibility that they don't know what they are debating, and they probably will make some arguments that don't make any sense. I think the GM is going to be responsible for their products. It's hard to shake off that responsibility in any situation.By the way, you can sue the government. Democracy is a brilliant thing.

I think it goes like this:
The old GM is responsible for lemon law, liability, etc. on old GM vehicles. New GM will be responsible for all aspects of New GM vehicles. Indicator - Chrysler is bouncing lemon law checks, and telling claimants to get in line at Bankruptcy court. Quote:

Ya you can sue the Government, but good luck. Sovereign Immunity was pretty much done away with for the states but the US still enjoys a great deal of protections.
From what I've read, I would expect that the surviving corporation would deal with the brands that still exist for large liability losses. The surviving corporation would also deal with warranty work on the dissolved brands. Some form of insurance pool (likely formed with federal dollars but not specified) would be formed to provide protection for the surviving corporation against claims made on the old corporation. |
