Angry Rock falls from overpass and smashes through my T-Top and hit me on my head.

What are the odds? Here is the news report that some guy in my town posted.



I wasn't going to do anything about it if they fixed my car, but now Norfolk and Southern Railroads are claiming that they only own half of the bridge. So I had to get a lawyer.

This happened on Monday and today the R.R. had a 50 man crew cleaning up all of the rocks off of the beams under the bridge. This has been on the news all week here in Pa.

I was on my way to drop the car off to get the tranny rebuilt. I ended up in the hospital for 6 hours.

Be careful about what you post if it goes to court... lawyers are all over the internet now and will use anything they can find. I hope you are okay and are able to get them to fix your car and cover your medical expenses. I remember when I was in highschool, our spanish exchange students said that the translation for what they called sunroofs where he was from was "watch out for falling coconuts".

God I hate how shady corporations have seem to become. They could cause a mass genocide and it would still be alleged and in "fine" condition. What happened to owning up to screw ups?

Fool what do you mean your not going to to anything I'm 17 and even I know thats a MULTI-MILLION DOLLAR CASE!!!!!!!, get the damn best lawyer in town and YOU GO TO COURT!!!!! Shi* with that money you could go to GM and get a camaro with any engine you want, wish it happen to me and I lived, I lie to you not I be a sueing ass lol

Nope. And I'm serious. I'd get what I needed/deserved, I see no reason to exploit the system for personal gain. I see hear about too much of that, and just get sick of every new case where someone gets millions because they lost thier pinky finger. (who uses that finger anyways?!?)

Maybe I'm just strange like that.....

But back to the topic, I'm glad you're okay...well, as 'okay' as you can be with having a rock hit you on the head. You are typing - so it couldn't have been too bad!

It simply does not work like that. You are 17 right, so you don't know what limited tort is do you? I'm not getting my hopes up for any big BONUS for this.

contrary to what the Norfolk Southern RailRoad will tell you, they are liable... and this comes from a Union Pacific RailRoad employee.

we had almost the same thing happen here in San Antonio... but the railroad was the sole owner of the bridge... when rocks and part of rail came falling down onto cars below, the citizens complained... and the UPRR doled out several thousand dollars in damages.

railroads make billions of dollars per year... your little $1000-1200 isn't going to make a dent in their budget... get them for the t-top, any detailing work that needs to be done to the interior of the car and for all your medical expenses due to the incident... when you talk to the right person (their claims agent or spin doctor is likely the only person or people you have talked to so far), your happiness will be important so as to avoid any more negative PR... and I highly recommend that you get in contact with the Superintendent's Office for the Norfolks Southern area you live near... the spin doctors and claims agents are there to keep the railroad out of trouble... the Superintendent is over their head.
