Completely off topic

The only thing this has to do with Camaros is that I AM a camaro owner. Hopefully the moderators let this topic live until i get a couple of answers.

Ok here is the situation. I work at a restaurant owned by my family. Just recently we had some roofers hired to work on the roof by the people that own the entire strip. Well it has been a complete nightmare with these roofers. They have been very unprofessional with there work. They seem to work at the busiest times of the day scaring customers with their hammering and banging. Causing ROOF material to fall through and get into customer food and cause the place to be a mess.

They turned the air conditioning unit on the roof off and and didnt tell anyone. So we had to call in someone thinking we had to repair it 3 times till they found out what was wrong. We were literally sitting in 100+ degree temps in the kitchen. And on top of that Because they didnt seal everything up properly after finishing up at night when it rained we got some water damage. They ruined the speakers and one of the flat screen TVs that we have mounted on the wall.

Here is my question. They are paying for the service call for the AC guys and are going to pay to fix the speakers. They just bought a brand new TV for us but are asking they get to take the old TV. Are we required to give them the old tv? Here I am thinking no. But I would love to know your personal opinions.

P.S.

To the mods if you dont allow this topic to live i completely understand, if you do its much appreciated, i havent seen anything like this situation through google and just curious about it and have no where i can think of to turn.

I would say yes you have to give them the old TV. They are buying you a new one. It is standard practice when a company to include the post office that when something is damaged and they pay to replace it you must give up the old one. Just like if your car was totaled then you get money from the insurance but you have to release the car to them.

Uhhh...... NO!!!!! And let me re-emphasize that.... NO!!!

Sorry, but they messed it up, you owe them NOTHING! In fact, they'd be lucky if they even got to finish the job, given your description of their work. If it were me, I would have fired them from the job after they replaced the damaged equipment, paid them for what they had already done and hired another REPUTABLE company to do the job on MY terms. I'm not a particularly mean-spirited person, but when I'm the customer...I expect to get what I'm paying for, and I don't expect to endure incompetence.

What he said!

These people owe you for damages they have caused. They should have to pay you for all repairs and are not entitled to take any damaged property. They should be reported to the BBB.

I would agree with most everyone else here and say NO, you don't owe them the old TV. I work for a national restaurant chain and spent several years in our property management department and I have never even heard of a reptuable company even asking if they get to the old one!

I do have a some questions for you. Since you say that this roofer is the roofer the owner of the strip uses, were you required by your lease to use this company? I know in many cases when we are in strip centers there are requirments to use the LL's roofing contractor to maintain an existing warranty. If so, you may have some recourse to go back to the owner as well. Are you paying for these roof repairs yourself, or is the LL handling the repairs as part of CAM or their maintenance responsibility under the lease?

Since they replaced the old one I wanted to see if it was capable of being repaired. If their services werent so horrible I think I would be more understanding in giving them the broken TV. Maybe...

Too be completely honest they didnt directly come out and say it but it seemed that their intent was to buy the same tv at walmart then return the broken one. To me that seems like there was no financial consequence to their actions

It is actually the entire strip that is having the roof changed so no we werent required to pay for any of the roofing that was actually being done. It was through the complications that surfaced because of the roofers neglect that we were having the said problems. All the stores in the strip actually had water damage. In fact the gas station next door had laptops that were ruined.

The chances are the cost for labor and parts are going to be more than the value of the TV. Let them have it and move on.

Exactly, just give the old TV up. If its ruined and is not operational then just give them the damn thing. move on
