McCarthy says that because of the legal issue having to do with privacy rights of individuals, CARB's plan to begin OBD-III in 2005 will include the right for vehicle buyers to refuse the system.

Doing more research, the earliest article I've found about OBDIII now dates back to 1998, again with no sources stating anything about a nationwide roll out anytime soon.
