This guy Gail Herbert Gerlach did not have his life threatened. Gail shot the guy in the back of the head as he drove away. (why didn't Gail shoot out the tires?)
He could have done that and then warned the driver not to move till the police arrive.
the thief had no gun. I hate theives but why risk having to go to jail over some old piece of crap looking suv. Gail can deal with this. (maybe he has a gun because his name is Gail.)
