The PD wouldn't have same liability as the victim who signs the affidavit. My guess is the dealership didn't just say "oh we made a mistake... go arrest him".

I cannot see the video, but my guess is they skewed a tad bit of the information they provided law enforcement. An investigation is as simple as an officer saying "did he steal the product and owe you money?" "yes". Probable cause established, affect the arrest. Investigators do not touch a case until after that person has been processed in jail, then they can decide to drop charges. My guess is, that probably happened.. but was awarded based on the dealerships malicious act.

Such as "he agreed to pay the remaining 5k, in exchange to take the car home that evening and has failed to return." While that is still civil, a criminal act could be articulated if they really wanted. The fact that his attorney believes he can get over 2 mil tells me the dealership didn't just make a woopsie and try to cover for it... they probably lied about how it transpired. If you purge yourself and lie as a company and it results in traumatic event as being taken to jail (yes, for 90% of the world... going to jail is extremely traumatic) then I think he deserves every single dime of at least 1 mil. More to the tune of 1.5-2... that dealership will probably never recover either... finally, some good news about a crappy dealership.

Every cop knows a dispute like that.. if it was explained properly to them, would still be civil and would not require police involvement.
