I compared all of them - price, performance, looks, etc... the only ones that are street legal have the CARB EO number (same as California emissions rules), and those all require a tune.
They actually test emissions here. The method varies depending on the vehicle, but I've never had to pop the hood on any of my cars. The guy at the shop said nobody has mentioned any problems with the K&N at emissions testing time... I'll hang onto the stock air filter, just in case.
