CARB's issue is that the key increases emissions, not that it increases emissions to beyond regulations specifically. They would have to test it to know if emissions were beyond regulations, which they haven't. Testing of the red key tune is not a priority to CARB because it is a third party product supplied by Ford Racing. Consumer vehicles built by automobile manufacturers are priority #1. Multiple people on the mustang forums have spoken to representatives at CARB and have been told that the keys are not being sold because they have not yet been approved by CARB, not that they have been rejected. CARB approval takes a long time for any aftermarket product, ask any of the vendors here that have gone through the process.
