Plus your hypothetical situation has a huge error. If the entire parking lot is empty, just take the spot next to the handicap spot. Normal parking is just one space away in most if not all lots. you save like what ten steps by using the handicap spot vs the next avail normal spot. It would be super stupid to get a ticket for parking in a handicap spot and the entire lot is empty.
The fact that you are even looking up state and fed law regarding handicap parking and you are not handicapped says something.
