Thats probably why you would be held responsible. So what you are saying, if I went behind the associations back and call Joe's Tree Removal service without the associations concent, I wont be held liable? Under this scenario I wouldnt have put in a maintenance claim.

I do agree that he shouldnt be charged for the damage, and if hes got his itinerary or proof he wasnt around during the time of the removal he should be able to work this out without a legal intervention.
