I guess it would fall along the same lines as speeding, swerving, not stopping at a stop sign. The driver is the responsible party if issued a ticket. It shouldn't matter who the owner is. If you decide to drive a vehicle with improper break lights, or illegal tint, you assume responsiblity.
The only time when the owner would be responsible would be when the vehicle would be impounded but the driver will still get the ticket.
