Maybe... depends if he was shot while in the actual act of vandalism, if so he can be subject to deadly force to stop him. But, if he takes off running he cannot lawfully be shot (or whatever). The exception would be if he was committing a crime while escaping (like stealing something or using a weapon), in which case deadly force is still permitted. Basically, it depends if the vandal is committing a crime at the moment deadly force is used...

The use of the word "retaliation" makes me believe the vandalism was committed at some point earlier in time... As for a memorial to the vandal...
