I'm all for a 30 day minimum sentence for the first offense, escalating to a 6 month minimum for the second and a 5 year MINIMUM for the 3rd (or in three strikes and you're out states, life). To me this is realistic, though to be honest I don't disagree with making it even tougher like you said.

I think we're thinking of two different scenarios. I'm talking about if the first offense includes an accident with injuries or death. I am getting the impression you're talking about if they're just pulled over and blow over the limit.
With the guy you mentioned, I'd have been the one in jail if I found his fender like that because the cops wouldn't have arrived in time. (Though I would at least call them and give them a fighting chance.)
