It's not in Canada where they do this practice as the Canadian bill of rights has a not withstanding clause. It's the most aggregious phrase you can have in a bill of rights it means that if the gov't be it police or any other gov't authority find it neccesary they can contravine the bill of rights. Right off the bat sorry for the politics but it does pertain to a question asked.
And as for the US if you have enough money Im sure you could fight it, but for a misdemeaner moving violation? I honestly would like to know tags or another police officers on here thoughts on this as to what the actual violation is listed as and what penalties or fines go along with it. I live in Canada, BC in particular were it has actually been a large problem among the young and stupid predominantly ricers and the penalties are getting pretty harsh.
