If you read the article, it was after Midnight when the Pirates attacked the USS Nicholas. So maybe they did not see that it was a War ship (it gets pretty dark at night when there are no city lights). also, it is possible that the frigate setup some lights to look a little more like a merchant ship, then a war ship. We used to do that during war games, and i was on a big ass Cruiser.

I would love to see some vids from this though!!!

Let's not send a Carrier, let re-commission a Battle ship again, and send that over!!
