There have been times where I allready was moving and hurried up and went. Never making it really close or anything but there have also been times where I was about to but had to slam em' on when I realized the oncoming was hauling ass. Usually results in a middle finger by me. You shouldn't assume the car is driving the posted speed limit but certainly can't be accountable if they are doing well over.
Go out on the interstate one day when there is no traffic and drive 95 mph and then slow down to 40. The difference is more than just half. There is an exponential difference in velocity. Just because you are doubling the mph doesn't mean you double the stopping distance or effects of a collision. You MORE than double it. MUCH more.
I'm sorry. IMO, had he been doing 40 or 45 mph, there would have been NO contact. prabably not even much more than a slight breaking by the cop. I bet the cop wouldn't have even pulled the car over had he been doing 40.
I gotta yeild to the AI guy on here though. He's obviously more experienced and qualified to audit the video.
