I have a ham license, btw. I think the reason hams can use scanners is because many ham transceivers just happen to scan police bands and since my license is federally issued, states have less authority to overule my use of those units. So if the unit didn't also work primarily on ham frequencies it may actually be illegal for me as well. Not for sure, but I'm just guessing. I don't think just having a ham license will allow you to legally use just any scanner. Again like you said that would vary state to state.

BTW, if you don't have a ham license, I think some states argue that if the device can also receive NOAA weather boradcasts then it's legal. And some say they are legal so long as you didn't use them in a crime. Which is funny IMO because if you're a criminal why would you care?
