It isn't just a matter of the converter being a poor design. It's a combination of things.
1) The TCC slip tables allowing the converter to slip when locked for smoother transitions in and out of AFM mode are suspect.
2) The Converter doesn't like being locked in all gears under all conditions. Which is why the aftermarket converters will not lock until 4th gear.
3) The OE fluid retains moisture. This might be somewhat of a problem but I don't see it causing shudder if issues 1 & 2 are not present.
