In Texas, you are normally charged with Intoxication Manslaughter, which will usually result in a couple years in jail. The lack of murderous intent is the major thing that prevents lengthy sentencing, combined with the fact that most people will admit to driving when they probably shouldn't have. Some people just get unlucky and hit someone. Yes, it's stupid and wrong, but unfortunately people just don't think clearly when they are hammered. Main reason why I drink at home if I feel like doing it.

Of course, if you have more than 3 DWIs in Texas and then kill someone, you can be charged with Intoxication Murder, which has a penalty range of 50-99 years.

see personally I don't agree with the manslaughter.

to me getting in a vehicle drunk is a very premeditated deliberate act.

no different as I have already stated than randomly picking up a gun and randomly shooting someone for no reason

Murder 2 would be the charge in that case and should be the charge in a DUI death..

of course I am bias, I have been involved in two accidents where I was hit by a DUI, and lost my first wife as a result of one of them.

there was a guy here up the highway in Arizona that did that last night and crashed into a truck carrying produce. there's been quite a few of them the last couple of years .

News is now reporting that the Camaro driver--- the one who drove the wrong way on the freeway at 100 MPH and murdered six people--- had JUST had her driving privileges restored after a suspension for a PREVIOUS DUI conviction.

She sure sounds like a quick learner.

I have to wonder what the heck was going on in that car right before the crash. FOUR PEOPLE in the Camaro and all were so hammered NONE of them realized they were on the wrong side of the freeway? Or was the driver intent on killing them all and they were screaming at her to stop? Was the driver feeling invincible and playing a game of ultimate chicken?

I heard on the local news last night that the sister had 11 issues with her license and drinking.Sounds like a fine upstanding family!
